I've been writing ST: DS9 Fanfic for some years now, and naturally I have
the same issues with it. Only Trek is controlled by Viaborg -- sorry,
Viacom, and they have taken people to court over copyright, while Chateris'
family does not seem to have the same "enthusiasim" for litigation that
Viacom does.
Personally, I think it comes down to money. If your story makes no money
(as Fanfic doesn't), and you show respect for the characters (as most
fanfic does), then why would they sue you for increasing their coffers in
the long term as people as interested and therefore will buy the books,
DVD's, etc.
Of course, the down side in that most of us probably are on first-name
terms with every secondhand book seller within 50km of our house, and so
books purchased through there don't contribute to copyright sales.
This would probably be a good time for me to shut up . . . . .
